Since 1955 the international law construct of neutrality is anchored in the Austrian constitution. This lecture assesses the legal implications of this neutral status in the wake of the EU response to Russia’s aggression against Ukraine. This includes an assessment of the core elements of neutrality, examples of potential violations of neutrality, and more broadly the distinction between military support and conflict participation. Since 2020 Erika de Wet is Professor of International Law and Head of the Institute of International Law and International Relations, University of Graz, Austria. She is also Honorary Professor at the University of Bonn (since 2015), Germany. She currently serves on the International Law Association’s Committee on the use of force: military assistance on request (Netherlands branch) and CoEditor-in-Chief of the Max Planck Yearbook of United Nations Law.
