Studierende der Uni Graz bestritten Moot Court in Straßburg

"Moot court" bedeutet so viel wie "fiktives Gericht" und meint einen Wettbewerb für Studierende der Rechtswissenschaften, denen dabei ein realer oder erfundener Fall zugeteilt wird. Es gilt dann, jeweils eine der Prozessparteien bestmöglich zu vertreten.

 

Die Finalrunde der von ELSA (European Law Students Association) organisierten European Human Rights Moot Court Competition fand von 23. bis 27. Februar 2014 in Straßburg statt. Das Team der Uni Graz, betreut durch MitarbeiterInnen des Instituts für Völkerrecht und internationale Beziehungen, schaffte es durch eine ausgezeichnete schriftliche Leistung in der Vorrunde, sich für dieses Finale zu qualifizieren.


Der zum zweiten Mal von ELSA in Kooperation mit dem Europarat und unter anderem auch mit Unterstützung des aktuellen österreichischen Vorsitzes im Europarat veranstaltete Moot Court soll Studierenden aus ganz Europa die Möglichkeit bieten, sich anhand eines fiktiven Falles näher mit der Europäischen Konvention zum Schutz der Menschenrechte und Grundfreiheiten auseinander zu setzen, das dazugehörige Verfahren kennen zu lernen und in die Praxis hinein zu schnuppern. Dazu mussten zunächst zwei Schriftsätze verfasst werden, die von einer Fachjury bewertet wurden, welche dadurch eine Auswahl an Finalisten traf.


In der mündlichen Runde, die direkt am Europäischen Gerichtshof für Menschenrechte in Straßburg stattfand, traten schließlich die 16 besten Teams aus über 120 Bewerbungen in simulierten Gerichtsverhandlungen gegeneinander an. Für die Studierenden eine sehr gute Gelegenheit, sich der Bewertung und dem Feedback der ExpertInnen, bestehend aus AnwältInnen und RichterInnen aus dem Fachgebiet der EMRK, zu unterziehen.


Obwohl der Gesamtsieg in diesem Jahr nach Großbritannien ging, fühlten sich die Studierenden der Uni Graz auch als SiegerInnen: "Alle Teilnehmenden der Finalrunde konnten einmalige Erfahrungen sammeln", sind sich die Studierenden sowie die Jury einig.
