In light of the election in Hungary, university assistant Rareș-David Chioreanu argues on the Verfassungsblog that an election victory does not legitimize “constitutional disobedience” against illiberal regimes. He demonstrates that disregarding the constitution is neither legally permissible nor politically wise. Instead, the article advocates for cooperation, institutional continuity, and gradual reforms to overcome existing, politically entrenched structures. Constitutional disobedience carries the risk of further undermining democratic principles and reinforcing authoritarian dynamics.
