On the ECHR Blog, Prof. (em.) Wolfgang Benedek examines the CDDH’s outcome document in relation to the planned Chișinău Declaration. The focus is on the implicit messages regarding the relationship between human rights protection, state sovereignty and migration. Whilst the final document formally adheres to existing standards, its tone suggests a more restrictive interpretation of the ECHR. In particular, security and migration policy considerations are gaining prominence. The article warns that this shift could undermine the level of protection afforded by the Convention and indirectly influence the case law of the European Court of Human Rights.
